Terms of Use
PMU Scientist™ | Ombre Beauty BV | Effective: August 1, 2025
These Terms of Use govern your access to and use of the PMU Scientist™ websites, learning platform, online courses — including The Science Behind Your PMU Art™ — live and recorded webinars, community membership known as The Science™ Circle, downloads, assessments, certificates, and all related services (collectively, the Services).
By purchasing, enrolling, accessing, or using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Clinical, Scientific and Educational Disclaimer, all of which form part of this agreement. If you do not agree, do not use the Services.
1. Who We Are
The Science behind your PMU art™ and PMU Scientist™ are founded, owned and operated by Akira Nitsche.

2. Eligibility
You must be at least 18 years old to use the Services. PMU Scientist™ is a professional education platform for PMU and micropigmentation practitioners. The content relates to invasive cosmetic procedures that require professional licensing in virtually all jurisdictions and is not intended for minors.
You must provide accurate account information, keep your login credentials secure, and comply with these Terms and all applicable laws. We may suspend or terminate access for any violation.
3. Your License to Access the Services
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Services solely for your own professional development. This license does not permit you to share, copy, reproduce, record, distribute, resell, teach, adapt, or create derivative works from any content, or to use any content to build competing education, AI systems, datasets, or commercial materials.
Access is personal to the registered learner only and may not be transferred or shared.
4. Content Offerings and Changes
We may cancel, interrupt, reschedule, update, modify, replace, remove, or restructure any course, webinar, module, assessment, assignment, certificate, community feature, bonus, downloadable material, or other content offering.
We may change the order, availability, format, timing, weighting, requirements, or structure of assignments, quizzes, assessments, modules, certification steps, or community features.
Access to particular features may depend on your purchase, plan, region, compliance with our policies, certification status, payment status, or technical availability.
5. No Academic Credit and No Automatic Licensing
Completion of our courses, programs, certificates, assessments, or memberships does not grant academic credit, university enrollment, medical qualification, legal authorization, government licensing, or professional registration.
Participation does not establish student status with any third-party educational institution.
After graduation, you do not automatically become a licensed PMU artist, tattoo artist, micropigmentation practitioner, aesthetic professional, medical professional, or regulated practitioner.
Licensing, registration, hygiene, health and safety, insurance, client consent, and treatment requirements are set by local law and vary by country, region, and profession. You are solely responsible for checking and complying with your local laws, insurance requirements, professional regulations, and scope of practice before performing treatments on clients.
6. Educational Nature — Not Medical or Legal Advice
The Services are provided solely for educational and informational purposes. Nothing we provide constitutes medical, dermatological, pharmaceutical, legal, regulatory, toxicological, financial, or professional advice, nor does it constitute instructions, recommendations, approvals, endorsements, or guarantees regarding any specific treatment, product, ingredient, pigment, device, manufacturer, supplier, client, or clinical situation.
The Services are designed to explain scientific principles, pigment knowledge, skin biology, color theory, safety concepts, professional development, and related topics at a general educational level. Scientific information presented through the Services reflects educational discussion and interpretation only and should not be relied upon as a substitute for professional, medical, legal, regulatory, or other specialist advice.
Any application of knowledge obtained through the Services is performed entirely at your own discretion and risk. You remain solely responsible for all professional decisions, client assessments, contraindication screening, treatment planning, pigment and product selection, device selection, hygiene and infection control, informed consent, insurance coverage, regulatory compliance, scope of practice, and treatment outcomes.
Please read our Clinical, Scientific and Educational Disclaimer carefully. It forms an integral part of these Terms and further defines the limitations and scope of the Services.
7. No Guarantee of Results
We make no guarantee of professional success, business growth, income, healed results, client retention, or any other personal or commercial outcome. Results depend on many factors outside our control, including your effort, skill, experience, market conditions, and individual client variables.
8. Professional Responsibility and Inherent Risks
You acknowledge that permanent makeup, micropigmentation, pigment removal, and related procedures involve inherent and unpredictable risks — including allergic reactions, infections, scarring, pigment migration, adverse healing, and regulatory compliance issues — that are entirely outside our control.
PMU Scientist™ is not responsible for any treatment you perform, any product or device you select, any client outcome, complaint, or injury, or any regulatory non-compliance on your part — regardless of whether you applied knowledge gained through our Services.
9. Intellectual Property
All content, recordings, slides, worksheets, frameworks, methods, names, logos, and materials associated with PMU Scientist™ are protected by copyright, trademark, and other applicable intellectual property laws. This includes PMU Scientist™, The Science Behind Your PMU Art™, The Science™ Circle, R.E.A.D.™, SCAN™, and the SCIENCE Framework™. The ™ symbol indicates claimed trademark rights; registration status varies by jurisdiction.
You may not copy, reproduce, record, distribute, resell, teach, adapt, translate, or commercially exploit our content in any form, or use our trademarks, names, badges, or logos without our prior written permission.
Infringement constitutes a material breach of these Terms. We reserve the right to terminate access without refund, revoke certifications, issue takedown notices, seek injunctive relief, and claim damages. As a genuine pre-estimate of minimum loss, we reserve the right to claim liquidated damages of up to EUR 10,000 per violation, without prejudice to claiming higher actual damages. 10. AI and Automated Use
You may not use any content, recordings, transcripts, frameworks, community discussions, or materials from the Services to train, build, fine-tune, or create any AI model, machine learning system, dataset, automated tool, or competing product — whether for commercial, internal, or personal purposes. Automated scraping, crawling, or bulk extraction of content is also prohibited.
11. User Content and Marketing Consent
By submitting content to the platform — including assignments, posts, feedback, community contributions, quiz responses, assessments, surveys, reflections, reviews, comments, or other educational submissions — you grant us a worldwide, non-exclusive, royalty-free license to use such content for operating, administering, improving, developing, and delivering the Services.
We will only use your full name, image, likeness, results, social media account, or other information that directly identifies you for external marketing or promotional purposes with your separate, explicit written consent, obtained independently from your acceptance of these Terms. You may withdraw such consent at any time by contacting [email protected].
Educational Submissions and Feedback
By participating in the Services, you acknowledge and agree that assignments, quiz responses, assessments, surveys, reflections, feedback, testimonials, community contributions, and other educational submissions may be reviewed, analysed, reproduced, adapted, quoted, published, and used by us for educational, research, quality improvement, community, promotional, marketing, and business purposes.
We may share excerpts, quotes, insights, observations, trends, learning outcomes, and educational responses derived from such submissions in full or in part, including references to a participant's first name, country, profession, or similar non-sensitive identifying information.
We will not publish your full name, contact details, image, likeness, social media account, or other direct personal identifiers without your separate consent where required by applicable law.
You are responsible for ensuring that any content you submit does not contain client personal data, confidential information, or third-party material for which you do not have a lawful basis or appropriate permission to share.
Live Sessions, Recordings and Educational Discussions
Live sessions, webinars, coaching calls, Q&A sessions, workshops, community meetings, and similar educational activities may be recorded, transcribed, summarised, analysed, and incorporated into educational materials, FAQs, case studies, training resources, recordings, course content, or related materials made available as part of the Services.
By participating in such activities, you acknowledge and agree that your questions, comments, contributions, discussions, observations, feedback, and educational interactions may appear in recordings, transcripts, summaries, educational materials, or related content distributed to other participants as part of the Services.
We will not intentionally identify participants in external marketing or promotional materials using their full name, image, likeness, contact details, social media account, or other direct personal identifiers without separate consent where required by applicable law.
12. Certification
The title PMU Scientist™ and any associated certificate, badge, or designation may only be used once officially granted in writing following successful completion of all applicable program requirements. Enrollment, payment, or partial completion does not confer certification status. We may refuse, suspend, or revoke certification for misrepresentation, misconduct, intellectual property infringement, or any act that undermines the integrity of our certification standards. False claims of certification constitute a material breach of these Terms.
13. Account Security and Unauthorized Sharing
Access to the Services is personal, individual, and non-transferable. You may not share your login credentials, allow others to access your account, use one account for multiple people, or share course recordings, downloads, or materials. We may monitor account activity — including login patterns, IP addresses, and device data — to detect unauthorized sharing. Confirmed unauthorized sharing may result in immediate termination without refund, revocation of certifications, and legal action. Account sharing is a material breach of these Terms.
14. Community and Platform Conduct
When using any community, forum, chat, live session, or interactive feature within the Services, you must act with honesty, respect, and professional integrity. You may not harass, defame, or intimidate others; post illegal, harmful, or misleading content; share client personal data without lawful basis; impersonate others or misrepresent your credentials; use community content to train AI or create competing materials; or record, copy, or redistribute sessions without our written permission. Violations may result in removal, suspension, or termination without refund.
15. Payments, Refunds and Chargebacks
Pricing and payment
Fees are quoted in EUR unless stated otherwise. Payments are processed by our third-party payment processor. Subscriptions — including The Science™ Circle — renew automatically until cancelled. Failure to pay may result in suspension or termination of access.
No-refund policy for accessed digital content
PMU Scientist™ delivers fully digital content that becomes accessible immediately upon payment. By completing your purchase, you expressly request immediate delivery and acknowledge that — in accordance with the EU Consumer Rights Directive — your right of withdrawal is waived once access has begun. We are therefore unable to offer refunds once access has been granted.
We will not refund on the basis of change of mind, incomplete course use, or personal dissatisfaction with outcomes not expressly promised by us. Exceptions are made solely for proven technical failures on our side that permanently prevented access, or clear billing errors. Requests must be submitted to [email protected] within 7 days with supporting documentation.
Chargebacks
Because access is granted immediately upon payment and cannot be reversed once content has been viewed, chargebacks initiated after access has been granted will be disputed. If you have a genuine billing concern, contact us first at [email protected] — we respond within 5 business days. Where a chargeback is found unjustified, we reserve the right to permanently revoke access, certifications, and community membership, and to refuse future enrollment. Nothing here affects your rights where a transaction was genuinely unauthorized or fraudulent.
16. Disclaimers
The Services are provided as is and as available without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and uninterrupted access. We may modify, suspend, or discontinue any part of the Services at any time.
17. Limitation of Liability
To the fullest extent permitted by applicable law, our aggregate liability arising out of or relating to the Services, whether in contract, tort (including negligence), statutory duty, or otherwise, shall not exceed the amount actually paid by you for the specific course, program, membership, subscription, or Service giving rise to the claim.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of profits, revenue, income, business opportunities, goodwill, reputation, clients, contracts, data, or anticipated savings.
Without limiting the foregoing, PMU Scientist™, The Science Behind Your PMU Art™, Ombre Beauty BV, and any instructors, employees, contractors, or service providers shall have no liability for any professional decisions, treatments, procedures, client assessments, pigment selections, product selections, device selections, regulatory interpretations, business decisions, treatment outcomes, healed results, adverse reactions, allergic reactions, infections, client complaints, client injuries, regulatory non-compliance, or any actions taken by you based on information obtained through the Services.
We are further not liable for failures, interruptions, inaccuracies, delays, or unavailability caused by third-party platforms, software providers, hosting providers, payment processors, internet service providers, or other third-party services used in connection with the Services.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
18. Indemnification
You agree to indemnify and hold harmless PMU Scientist™, Ombre Beauty BV, and our officers, employees, instructors, and service providers against any claims, damages, losses, and costs — including legal fees — arising from your use of the Services, violation of these Terms, your User Content, misuse of our intellectual property, false claims of certification, or any treatment, procedure, or client interaction you perform, whether or not based on knowledge gained through our Services.
19. Force Majeure
We will not be in breach of these Terms, nor liable for any delay or failure to perform our obligations, to the extent that such delay or failure results from events, circumstances, or causes beyond our reasonable control.
Force majeure events include, but are not limited to:
- Natural disasters, pandemics, epidemics, or public health emergencies
- Acts of government, war, civil unrest, terrorism, or sanctions
- Failure of third-party platforms, including our learning management system (Kajabi), payment processors, or hosting providers
- Internet outages, cyberattacks, or widespread technical failures
- Strikes, labor disputes, or supplier failures beyond our control
In a force majeure event, we will make reasonable efforts to restore the Services as soon as practicable and will communicate with affected learners where reasonably possible. Where access is interrupted for a sustained period due to force majeure, we may, at our sole discretion, extend access periods or provide alternative arrangements. We are not obligated to provide refunds solely due to force majeure-related interruptions, except where required by mandatory applicable law.
20. Governing Law and Dispute Resolution
Before initiating formal proceedings, you agree to contact us at [email protected] to attempt good-faith resolution within 30 days. If unresolved, EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
These Terms are governed by Belgian law. The competent courts of Belgium have exclusive jurisdiction, subject to mandatory consumer protections applicable in your country of residence that cannot be waived.
21. General
We may update these Terms at any time. Material changes will be communicated by email or platform notice before taking effect. Continued use after the effective date constitutes acceptance. We may suspend or terminate your access for any breach of these Terms, with surviving obligations including intellectual property, confidentiality, disclaimers, liability, indemnification, and governing law. We are not liable for failures caused by circumstances beyond our reasonable control, including third-party platform outages, natural disasters, or government actions.
